This End User License Agreement (the "Agreement") is between you and Wyvern Systems LLC (the "Licensor"), and governs your use of the BotLegger application, its command-line tools, its server program, and any updates (together, the "Software"). By installing or using the Software you agree to this Agreement. If you do not agree, do not install or use the Software.

1. License

The Licensor grants you a personal, non-exclusive, non-transferable, revocable license to install and use the Software on devices you own or control, for your own use, in accordance with this Agreement and the documentation.

2. Restrictions

You may not, and may not allow others to:

  • copy the Software except as needed to install and run it and to keep a backup;
  • modify, translate, adapt, or create derivative works of the Software;
  • reverse engineer, decompile, or disassemble the Software, except to the extent that applicable law expressly permits this despite this limitation;
  • sell, rent, lease, sublicense, distribute, or otherwise transfer the Software or make it available to third parties as a hosted service;
  • remove or alter any proprietary notice in the Software;
  • use the Software to violate any law or any third party's rights.

3. Your accounts, keys, and data

The Software runs on your devices and connects to third-party services (such as AI model providers, email, calendar, cloud storage, chat, and hosting providers) only with accounts and keys you supply. Your use of those services is governed by their own terms, and you are responsible for the charges they bill you. Your bots, chats, keys, and files stay on your devices or in services you chose; what the Software sends to the Licensor is described in the Privacy Policy (https://botlegger.com/privacy).

4. Bots act on your behalf

The Software lets AI bots read, write, send, and run things using the access you grant them. You are responsible for the permissions you grant, for reviewing actions before approving them, and for anything a bot does with the access you gave it. The Licensor does not control and is not responsible for the output of third-party AI models.

5. Third-party components

The Software includes open-source and third-party components under their own licenses, listed in the Software's Licenses screen and in the accompanying THIRD_PARTY_NOTICES.txt. Those licenses apply to those components instead of this Agreement where they conflict.

6. Updates and the BotLegger account

The Software may check for updates and may require a BotLegger account to run. The Licensor may change, suspend, or discontinue features or the account service with reasonable notice where practical.

7. Ownership

The Software is licensed, not sold. The Licensor and its licensors keep all right, title, and interest in the Software, including all intellectual property rights. Nothing in this Agreement transfers any of those rights to you.

8. Term and termination

This Agreement lasts until terminated. It terminates automatically if you breach it. You may terminate it at any time by uninstalling the Software. On termination you must stop using the Software and delete all copies. Sections 3, 4, 7, 9, 10, 11, and 12 survive termination.

9. Disclaimer of warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT BOTS WILL ACT AS YOU INTEND. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE LICENSOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR BUSINESS, ARISING OUT OF OR RELATED TO THE SOFTWARE OR THIS AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE LICENSOR'S TOTAL LIABILITY UNDER THIS AGREEMENT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR TEN US DOLLARS IF YOU PAID NOTHING.

11. Export and sanctions

You may not use or export the Software in violation of applicable export control or sanctions laws, and you represent that you are not located in, or a national of, a country or on a list to which such laws prohibit the export of the Software.

12. General

This Agreement is governed by the laws of the State of Texas and the United States, without regard to conflict-of-law rules, and any dispute will be brought in the state or federal courts located in Texas. If any provision is held unenforceable, the rest remains in effect. This Agreement is the entire agreement about the Software and replaces any earlier understanding. The Licensor may update this Agreement for new versions of the Software; the version that ships with the Software you use applies to it.
